Agreement
These Terms of use (“Terms”) govern access to and use of HomePTKit (the “Service”) operated by Daryl Bleach, a sole trader trading as HomePTKit (“we”, “us”, “our”). Contact us by email at support@homeptkit.com or hello@homeptkit.com. By creating an account or using the Service, you agree to these Terms and our Privacy policy. If you do not agree, do not use the Service.
Additional role-specific terms apply: PT terms and client terms.
Account types
HomePTKit is multi-tenant. There are two main roles:
Personal trainers (PTs)
You create a PT space, publish challenges and memberships, invite clients, and receive client payments via Connect. You are responsible for your coaching content, pricing, marketing claims, and the coaching relationship with your clients.
Clients
You join a PT’s space, purchase challenges or memberships, and use the client shell for sessions, progress, and community features your PT enables. You pay your PT; HomePTKit provides the software and payment rails.
You must be at least 18 (or the age of majority in your jurisdiction) to create an account.
Fees & payments
- Platform fee — HomePTKit charges 7.5% of client payments processed through the Service (challenges and memberships). We only take this fee when you earn.
- Monthly fee — £0 monthly platform fee to PTs.
- Card fees — Stripe’s normal card processing fees pass through at Stripe’s rates. They are separate from HomePTKit’s 7.5% application fee and are not a HomePTKit markup.
- Who clients pay — Clients pay the PT. Payouts are made to the PT’s connected account via Stripe Connect Express, subject to Stripe’s onboarding, verification, and payout rules.
- Refunds & chargebacks — Handled according to the PT’s stated policy and applicable payment-provider rules. Platform fees already taken on a payment may be non-refundable except where we agree otherwise or law requires.
- Taxes — PTs are responsible for their own tax and accounting obligations on earnings.
Content & intellectual property
- Your content — You retain ownership of content you upload (videos, PDFs, programmes, meal-plan templates, branding, community posts). You grant us a limited licence to host, display, and transmit that content solely to operate the Service for you and your clients.
- Our IP — HomePTKit branding, software, design, and documentation remain ours (or our licensors’). You may not copy, scrape, or reverse-engineer the Service except as allowed by law.
- Client access — Clients receive a personal, non-transferable licence to access purchased challenges and memberships while their entitlement is active, subject to these Terms and the PT’s rules.
- Infringement — Do not upload content you do not have rights to. We may remove content or suspend accounts that infringe others’ rights.
Acceptable use
You agree not to:
- Break the law, or use the Service for unlawful coaching claims (including unauthorised medical advice).
- Harass, abuse, or discriminate against other users.
- Upload malware, scrape the Service without permission, or attempt unauthorised access.
- Misrepresent your identity, qualifications, or relationship to HomePTKit.
- Circumvent fees, payment flows, or security controls.
- Use the Service to spam, phish, or run marketplace abuse.
We may suspend or terminate accounts that breach these rules.
Availability & changes
We aim to keep HomePTKit reliable but do not guarantee uninterrupted access. We may change features, set reasonable usage limits, and update these Terms. Continued use after an update constitutes acceptance of the revised Terms, unless applicable law says otherwise. Material fee changes for PTs will be communicated with reasonable notice where practicable.
Fitness & coaching disclaimer
HomePTKit provides software and payment rails. We do not provide personal training, medical, or nutritional advice. Coaching content is created by independent PTs. Clients should seek medical advice before starting exercise programmes where appropriate. Results vary; we do not guarantee fitness outcomes or PT earnings.
Liability
Nothing in these Terms excludes or limits liability that cannot be excluded under English law (including for death or personal injury caused by negligence, or fraud). Subject to that:
- The Service is provided “as is” and “as available” to the fullest extent permitted by law.
- We are not liable for coaching quality, client–PT disputes, third-party payment-provider outages, or loss of profits, data, or goodwill arising in connection with the Service.
- Our aggregate liability to you arising out of or in connection with the Service in any 12-month period is limited to the total platform fees you paid to HomePTKit in the 12 months before the claim.
Suspension & termination
You may stop using the Service and request account closure via support@homeptkit.com. We may suspend or terminate access for breach of these Terms, non-payment of recoverable fees, legal risk, or prolonged inactivity. Provisions that by nature should survive (IP, fees owed, liability, governing law) will survive termination.
Governing law
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that consumers may benefit from mandatory protections in their country of residence where applicable.
